This Acceptable Use Policy ("Policy") sets forth the guidelines and terms for the use of Openly Nerd's services. By utilizing our services, you agree to adhere to this Policy. Openly Nerd reserves the right to revise, amend, or modify this Policy at any time and in any manner.
- Lawful Use: You shall use Openly Nerd's services solely for lawful purposes. Transmission, storage, or presentation of any information, data, or material in violation of the laws of the jurisdiction in which you operate or the United States is strictly prohibited. This includes, but is not limited to, copyrighted material for which you are not the copyright holder, material that is threatening or obscene, or material protected by trade secrets or other statutes. You agree to indemnify and hold Openly Nerd harmless from any claims arising from your use of the service that may damage you or any other party.
- Prohibited Activities: Openly Nerd reserves the right to terminate services for any customer or end-user activity that exposes us to legal liability or jeopardizes our ability to provide services to other customers. The following activities are strictly prohibited and may result in immediate suspension or termination of services. Similar or Related activities that we deem to be in violation will also result in ban or suspension:
- Child Pornography: Hosting, distributing, or linking to pornography involving a person under legal age.
- Copyright Infringement: Hosting, distributing, or linking to copyright-infringed materials.
- CPU/Memory/Resource Abuse: Consuming an excessive amount of server resources that impairs the performance of the server for other users.
- DoS Source: Originating or participating in a Denial of Service attack.
- DoS Target: Being the target of a Denial of Service attack.
- File Scripts: Hosting or distributing file dump/mirror scripts.
- Forgery: Faking an IP address, hostname, email address, or header.
- Fraud Site: Hosting or linking to a website intended to deceive the public, including sites listed at aa419.org and escrow-fraud.com.
- Hate Speech: Engaging in serious attacks or phrasing that promotes discrimination, denigration, objectification, harassment, or violence based on attributes such as race, ethnicity, national origin, religion, gender identity, sexual orientation, disability, physical characteristics, veteran status, or medical condition.
- HYIP: Hosting or linking to a High-Yield Investment Program website.
- Identity Theft: Hosting, distributing, or linking to stolen account identification information.
- Infection: Hosting, distributing, or linking to exploits, trojans, viruses, or worms.
- Investment Sites: Hosting or linking to sites related to Forex, E-Gold Exchange, Second Life/Linden Exchange, Ponzi schemes, MLM/Pyramid schemes, High-Yield Interest Programs (HYIP), or similar.
- IRC: Hosting an Internet Relay Chat server, including IRC scripts/bots.
- Mass Storage: Storing a significant amount of backups, archives, videos, or similar data.
- PayDay Loan Sites: Hosting or linking to sites associated with PayDay loans or PayDay loan affiliate programs.
- Pharmacy Sites: Facilitating the sale of controlled substances without appropriate permits, including sites designated as rogue on legitscript.com.
- Phishing: Engaging in identity theft by email under false pretenses.
- Proxy Site: Hosting or linking to an anonymous proxy server.
- Bulk Email: Sending more than 500 emails of similar content (opt-in).
- Spam Email: Sending unsolicited commercial email (UCE) or unsolicited bulk email (UBE).
- Spam List: Hosting, distributing, or linking to email address lists for spamming.
- Spam Site: A site advertised by spam email or spam web.
- Spam Ware: Hosting, distributing, or linking to software designed for spamming.
- Spam Web: Engaging in unsolicited, bulk, or forged site advertisement in web logs, forums, guestbooks, or social media.
- Spamhaus: Causing blacklisting of an IP at www.spamhaus.org for malicious activity.
- Terrorist Site: Hosting or linking to a site advocating terrorism.
- Toolz: Hosting, distributing, or linking to tools or instructional material on hacking, cracking, or other illegal activities.
- Trademark: Hosting, distributing, or linking to trademark-infringed materials.
- Warez: Hosting, distributing, or linking to crackz, hackz, keygenz, serialz, or pirated software.
- Any other material Openly Nerd judges to be threatening or obscene.
- Resource Usage: Each customer is required to utilize server resources responsibly, ensuring reasonable performance for all users. Excessive consumption of CPU, disk space, or memory, which interferes with or prevents normal service performance for others, is not permitted. Openly Nerd reserves the right to suspend or terminate services for accounts that, at our sole discretion, abuse server resources, with or without prior warning.
- Copyright Complaints: Openly Nerd's designated agent for receiving copyright complaints is available at copyright@openlynerd.com Please follow the Digital Millennium Copyright Act ("DMCA") when submitting copyright complaints. Complaints that do not comply with the DMCA will not be processed.
- Customer Code of Conduct: Openly Nerd is committed to providing a safe and respectful environment for our employees and customers. By using our communication systems, including chat, email, social media, or telephone, you agree to the following guidelines:
- Discrimination: Customers may not discriminate against Openly Nerd employees or other users based on attributes such as age, race, ethnicity, national origin, religion, gender identity, sexual orientation, disability, physical characteristics, veteran status, or medical condition.
- Hate Speech: Customers may not engage in hate speech, including serious attacks or language that promotes discrimination, denigration, objectification, harassment, or violence based on attributes mentioned above.
- Spam: Sending unsolicited messages, repetitive messages, unnecessary emails, or engaging in other spamming activities may result in warnings and, in extreme cases, a ban from our communication systems.
- Offensive Language and Disrespect: Inappropriate language or behavior that is disrespectful to Openly Nerd employees or other users will result in warnings and, in repeated cases, a permanent ban from our communication systems.
- Unlawful Threats: Threats against Openly Nerd employees or the company itself are strictly prohibited and may lead to immediate termination of services and reporting to relevant authorities.
- Unsolicited Links and Attachments: Customers should refrain from sending unsolicited links and attachments unless specifically requested by an Openly Nerd representative. Repeated offenses may result in warnings.
All bans are considered permanent, and any threats of litigation will be referred to our legal team, with communication limited to Openly Nerd's legal representatives.
